Judicial Scandal: Declare Chief Justice Committee Illegal

Following the explosive investigative piece by Anas Aremeyaw Anas, a committee constituted by the Chief Justice found about 30 judges in the High Court and Circuit Court culpable of bribery. Many judges were subsequently dismissed, leading to a melee of court suits against the judiciary.

High Court Justices Paul Uuter Dery, Mustapha Habib Logoh, and  Gilbert Ayisi Addo who were caught in a secretly recorded video allegedly compromising their work are currently facing an impeachment process.

The three who have vehemently contested the content of the video and the process being used to kick them out of the judiciary filed a suit at the Supreme Court seeking several declaration against the Chief Justice, the Chief Justice Committee and the Attorney General.

In the writ filed on April 27, 2018, the three want “An order declaring as nullity and of no effect the prima facie case that the 1st defendant would have made against the plaintiffs in exercise of her function pursuant to Article 146 (3) and (4) of the constitution as same is in a contravention of Article 296 (C) of the constitution”.

They are also praying the superior court to declare that the Chief Justice could not have made a determination of prima facie case against them without enacting a constitutional instrument to govern her conduct.

According to them, the Chief Justice who is the 1st defendant would contravene Article 296 (C) of the Constitution if the constitutional instrument is not in place before the committee was set up.

“A declaration that the conduct of the 1st Defendant in setting up the 2nd Defendant committee to investigate the petition against the Plaintiffs is unlawful as same is in contravention of Article 296(C) of the Constitution.”

Meanwhile, Justice Mustapha Habib Logoh has filed a separate motion at the High Court asking it to stay proceedings of the committee with regards to the bribery allegation against them.

The Chief Justice is the 1st defendant with Nana Opoku Asomani who is the Secretary to the Chief Justice Committee and the Attorney General as the 2nd and 3rd defendants respectively.

He wants the committee to proceed work only after the Supreme Court has determined a case before the court in relation to the committee’s work.

The suits follow an order by the Community Court of West Africa in Abuja, Nigeria asking Ghana not to proceed with impeachment proceedings Justices Uuter Dery, Mustapha Habib Logoh and Gilbert Ayisi Addo claiming violations of their human rights. READ MORE

The motion would be moved on May 17, 2018.
