Embattled judges, Justice Paul Uuter Dery and Justice Habib Logoh, have challenged the Chief Justice, Theodora Georgina Wood, for selecting a private legal practitioner to represent her in court instead of the Attorney General.

The two, who are fighting the actions of the Chief Justice at the Supreme Court over their role in the judicial corruption scandal, together with Justice Gilbert Ayisi Addo, argue among other things that “…it is only the Attorney General…who has a constitutional responsibility to represent the Chief Justice…as lawyer in all civil actions against the Chief Justice in any court in Ghana.”

The three justices were part of 22 others indicted in the judicial corruption exposé by investigative journalist, Anas Aremeyaw Anas and his Tiger Eye PI team.

Justice Logoh had earlier cited the Chief Justice, Justice Theodora Georgina Wood for contempt of court.

The embattled Justice questioned why the Chief Justice was going ahead to begin impeachment proceedings against him, when he has other suits pending in court in relation to his interdiction.

In his latest writ, Justice Logoh and his colleagues argued that, during the case, the Chief Justice “purportedly instructed Kizito Beyuo, a private legal practitioner, to represent her as lawyer” in the case”, which suit is challenging the official acts of the Chief Justice, the 1st Defendant herein.”

The three justices are however praying the Supreme Court to declare “the entry of appearance filed by Kizito Beyuo for and on behalf of the Chief Justice as alien to the rules of practice and procedure of this court prescribed in C. I. 16 and as such, same as void.”

“An order nullifying the entry of appearance by Kizito Beyuo, for and on behalf of the Chief Justice, the 1st Defendant herein.”
