According to the Judge, one can only file either of the applications at a time and has thus struck out the case and fined Nana Konadu Agyeman Rawlings and NDP GHC10,000.

Justice Koomson also said by seeking for both enforcement of fundamental human right and judicial review will be embarrassing to the court and will cause undue delay to the case.

Kasapa FM’s court correspondent, Daakyehene Ofosu Agyeman, reported that lawyer for Nana Konadu Agyemang Rawlings, Ace Ankamah took told the court decision in good faith and assured that another application will be filed in the afternoon.

The National Democratic Party (NDP) sued the Electoral Commission in an attempt to get the election management body to reinstate its flag bearer Nana Konadu Agyeman-Rawlings in the December 7 presidential election.

The suit, filed on Monday, 17 October, makes the NDP the third to sue the EC in connection with the disqualification of 13 aspirants.

Apart from the former First Lady, 12 other aspirants were disqualified by the EC. over anomalies found on their nomination forms.

They include the flag bearer of the All People’s Congress (APC), Hassan Ayariga; Dr Edward Mahama of the People’s National Convention (PNC); Dr Agyenim Boateng of the United Front Party (UFP); Kofi Akpaloo of the Independent People’s Party (IPP); and Kwabena Adjei of the Reformed Patriotic Democrats (RPD) among others.
