Court Dismisses ECG Interlocutory Injunction Case

An Accra High Court has dismissed an interlocutory injunction application filed against the government on its plans to cede part of the operations of the Electricity Company of Ghana (ECG) to a private company.

According to the ruling delivered by Justice Norvice Aryene, the plaintiff lacked capacity in bringing the suit to court as they failed to show how the privatization will affect him personally.

The plaintiff, Saaka Salia, who is also member of the opposition New Patriotic Party’s (NPP) communications team sued the Millennium Development Authority(MiDA), arguing that it is not fit to participate as an adviser in the concession arrangement for the ECG because its conduct breached Ghana’s laws after it authored and circulated a draft tariff methodology.

Mr. Salia’s writ asserted that, the PURC, not MiDA is the body with exclusive mandate by law to provide guidelines for determining tariffs and levels of tariffs, and in doing so in the manner prescribed by Act 538.

But the Justice Aryene dismissed the case emphasizing that Mr. Salia lacked the capacity in bringing the suit to court as he failed to show how the privatization affected him.

Speaking to Citi Business News earlier, the Chief Executive Officer of MiDA,  Ing. Owura Safo described the suit as incompetent, false and lacking merit.

According to him, the allegations set in the suit were false, since MiDA has undergone all the necessary requirements and legal procedures needed to bring the Ghana Power Compact II into force.

Under the Power Compact, six projects will be implemented to address the root causes of the unavailability and unreliability of power in Ghana

The Government of Ghana signed the Ghana Power Compact with the Millennium Challenge Corporation (MCC), an independent United States government agency, on the sidelines of the US Africa Leaders’ Summit in Washington on August 5, 2014.

The Compact would provide Ghana with a grant sum of four hundred and ninety eight million, two hundred thousand United States Dollars.
