Senior NPP Member Sues Chief of Army Staff Over Land Dispute

Nana Obiri Boahen, the Deputy National Secretary of the New Patriotic Party (NPP) is suing Major General Richard Opoku-Adusei, the Chief of Army Staff and three others at a high court in Sunyani over a land dispute.

The other defendants include the Attorney General (legal representative of the Ghana Armed Forces), a pay louder and caterpillar driver only known as Burkina, and Kwaku Frimpong, a resident a resident of Techiman and son of the Techiman Queen mother Nana Afia Abrafi Koto.

Nana Boahen, who is a legal practitioner, is seeking an order to restrain Major General Opoku-Adusei and the Attorney General, and the two others (agents of chief of army staff) from interfering, entering and developing the four plots of land at Tuobodom in the Techiman North District of Brong-Ahafo region.

An accompanying affidavit filed at the “Enso Nyameye Chambers”, a Sunyani-based legal firm, and made available to the reporters is asking the court to compel Major General Opoku-Adusei to pay the market value of five thousand–six inches blocks, 10 trips of sand and four trips chippings.

It is explaining that the plaintiff is the owner of the four building plots at the Tuobodom stool land adding that on July 21, 2014, Major General Adusei hired some agents with assistance and support of armed military officers destroyed the building materials.

The affidavit is saying by the virtue of their official positions, the first and second defendants are sending platoons of well armed soldiers to the plots in dispute, intimidating, harassing, bullying and molesting innocent people.

According to the affidavit, Major General Opoku-Adusei is laying ownership of the building plots by virtue of purported national assignment and he is developing the land.

It says work is going on steadily on the plot in dispute by Major General Opoku-Adusei who has instructed, directed and instigated well armed soldiers to parade and guard the land.

The affidavit is observing that the conduct of the senior military officer undermines the efficacy and potency of the rule of law to insult the judiciary and to bring the administration of justice to public ridicule and contempt.
