Judge Mary Senkyire’s Decision Invited Delta Force Brutality – JOY

The independent Presidential Candidate in the 2016 general elections Jacob Osei Yeboah has stirred the controversy surrounding the operations of Kumasi based political vigilante group with affiliation to the ruling New Patriotic Party (NPP) Delta Force.

The man who is also referred to as Joy2012 has blamed the trial judge Mary Senkyire for not ‘thinking through’ her judgement thereby angering the vigilante group to attack the court.

It would be recalled that members of Delta Force, a vigilante group affiliated to the New Patriotic Party (NPP), have attacked a Kumasi circuit court and freed their members who were standing trial.

The court was hearing a case of assault and destruction of public property against 13 members of Delta Force for brutally assaulting the newly appointed Ashanti Regional security coordinator, George Adjei when other members of the group stormed the facility and destroyed property and also attempted to beat the trial judge before releasing their members.

The report said the trial judge, Mary Senkyire, had ruled that the 13 be remanded to appear before court on the 20th of April, 2017, but the Delta Force members in court rejected the ruling and proceeded to destroy court property.

While some Ghanaians including Civil Society Organizations (CSOs) and the Ghana Bar Association (GBA) have publicly condemned the actions of the vigilante group, Jacob OseiYeboah in his reaction on Onua Fm Morning Show, told Bright Kwesi Asempa that if trial judge on the case think through her decision well, it would not have angered the rest of the members of Delta force to attack the court.

“I know the judge was carrying out her duty but I must be frank that she did not give deeper thought to her decision on that occasion, and such actions can lead to chaos. It was the actions of the judge that resulted in that reaction from the group.”

Explaining further, Joy2012 insisted that why should a law enforcement agency duly granted the accused persons bail and have freely walked to the court, but at the court there wasn’t a complainant therefore there was no need for the judge to remand the accused persons in remand custody. Although he agreed that the judge has an authorityto give ruling, her decision at that material moment was problematic, stressing that judges are not God and therefore are fallible.

He noted that if the trial judge Mary Senkyirehad not detained the members of the vigilante group, the rest of the group members would not have attacked the court. Asked if he thinks the trial judge erred, Joy2012 said “The judge’s decision was not wise, hence the chaos”

“I am saying to me, the judge should have read the situation well because there were only four Police officers present at the court that day so the judge should have been tactful in her ruling”
