MacDan Clashes With Action Chapel Over Ghana Airports Land

There is a seeming tension between the Action Chapel International and the owners of McDan Shipping Company over a parcel of land leased to the church by the Ghana Airports Company Limited (GACL) for a car park.

Even before Action Chapel could start utilizing the 4 acres of land after clearing it, GACL wrote back to the church explaining that apportioning the land to the church was an “error.”

But, citifmonline.com understands that the GACL has reallocated the said area to owners of McDan Shipping Company who are currently undertaking some development project at the site despite a court injunction.

Owners of the shipping company are alleged to have deployed some land guards to police the area while the construction continues in earnest despite the injunction secured by the church.

Information gathered by citifmonline.com also indicates that because the land is close to the Kotoka International Airport, no high rise building is permitted there.

Background

Documents sighted by citifmonline.com suggest that the area under contention is a flight path and was originally given to the Action Chapel by GACL to be used as a car park.

One of the documents signed by the then Managing Director of the GACL, Charles K. Asare on December 19, 2016 stated: “we refer to your letter dated December 23, 2015 for allocation of land adjacent to your Chapel along the Spintex road and per the Board’s approval on December 16, 2016 hereby submit to offer you license for the use and occupation of the land.”

“You are required to indicate acceptance in writing within fourteen (14) working days from date of this letter, “the statement added.

But few months later, another letter from GACL on April 2017, said giving the land to Action chapel was an “error.”

The letter signed by the Director of Commercial Services at GACL, S. Kofi Yeboah said: “We notice that the site plan attached to our offer letter wrongly depicted the alignment of the proposed site for allocation to you which is inconsistent with the general lay-out of the location. The error was inadvertent and regretted. As you may have noticed, development has already commenced on the southern half of the plan forwarded to you by another applicant involving heavy investment and was not intended to be included in your allocation for a car-park.”

However, aggrieved by this new position by the GACL, Action Chapel subsequently took the case to court and successfully won an interlocutory injunction stopping any development project on the land in question until the differences are resolved.

In spite of the court injunction, however, McDan is undertaking development projects on the land.

Meanwhile, information reaching citifmonline.com indicates that the current Managing Director of GACL, John D. Attafuah has scheduled a meeting with the parties involved on Friday, May 26, 2017 to discuss the issue.
