The Labour High Court in Accra has dismissed an action brought by some ex-soldiers who were challenging their wrongful dismissal from the Ghana Armed Forces seven years ago.
The 1,350 ex-soldiers sued the Ghana Armed Forces (GAF) and Chief of Defence Staff with the Attorney General as a nominal party, arguing they were wrongfully discharged from the GAF in 2010.
They argued in their suit that their recruitment was subject to terms and conditions laid down in the regulations of the GAF, but their removal did not recognize that process.
Accordingly, they prayed the court to declare as unlawful, their dismissal on claims that it was done without recourse to the GAF regulations and due process.
Also, they had wanted the court order the defendants to pay each of the 1,350 plaintiffs a GHc20,000-compensation.
But at the end of hearing, the court presided over by Justice Lorinda Owusu held the ex-soldiers failed to establish a clear case against their former employer hence their reliefs could not be granted.
She accordingly dismissed the suit. No cost was awarded against the plaintiffs.
Lawyer Victor Kwasi Opoku for the ex-soldiers has meanwhile disagreed with the judgement of the court and served notice his clients will immediately appeal against it.
